When you use our services and share information with us, for example when registering for the member portal, personal data may be collected, processed or used in order to improve those services. Our Privacy Policy therefore explains how we collect information, why we collect it, and how we use that information once it is collected.

By using our website, you agree to the following Privacy Policy and consent to MHM collecting, processing and using your personal data in compliance with data protection legislation and the following provisions.

3. Collection, processing and use of personal data

We collect information to provide better services to all of our users. When using our website and as part of the portal registration process, personal data may be collected, processed and used.

3.1 Personal data

Personal data are particulars about factual or personal circumstances of a defined or definable natural person. This includes information that may infer your identity, such as your name, phone number, address, e-mail address or any other personal information. Statistical data that is for instance collected when you visit our website and that cannot be associated directly to you personally do not fall within this definition of personal data.

3.2  Collection, processing and use of your personal data

The protection of your data is of major importance for us. We align the collection, processing and use of your personal data to the principles of data minimization and data reduction. We use the information we collect from all of our services to deliver, uphold, protect and improve them. Within the website, mainly the password-protected area sections require you to provide personal data.

3.3 Registration

If you are a non-registered visitors to the website, we only collect information necessary to correctly display the pages you are visiting. The main services of the website, are only accessible to you when you register/sign up.

For your registration, we require the following information from you:

– Your first name

– Your last name

– Your e-mail address

– Your nationality

– Your university

– Your degree subject
We save the data you enter to set up your user account through which you can access the portal using your e-mail address and your password.

You agree to keep your login information confidential and inaccessible to any unauthorized third parties. We will treat the access strictly confidential and will not at any time ask for the password to be given to us.

3.4 Transfer of data to third parties

 Sharing of the data collected by MHM with third parties will only occur if necessary and permitted by law. MHM will not at any time process any of the information provided by the User to any third party for any commercial purposes unless MHM transfers the curriculum vitae of registered users of the website to partners of MHM and/or MHM Group GmbH.

3.5 Deletion of Data

Your personal data will only be deleted if you submit a request for cancellation and if legal retention requirements do not preclude the request; if the data are no longer necessary to fulfill the intended purpose of the saving or if data storage is inadmissible for other legal reasons.

4. Cookies

Cookies are small files stored on your disk that contain settings and data for exchange with our system via your browser. The acceptance of cookies is not a requirement for visiting the website. However, some website features may not work properly if you do not allow us to set cookies. We only use the so-called first-party cookies, which help to improve usability of our services. Our cookies are either invalid after the end of the browser session (session cookies) or remain on your disk (so-called persistent cookies) for a maximum of 30 days. Cookies do not store personal data. The cookies we use are so neither assignable to you nor to any other specific person.

6. Social Media Plug-Ins

One of the features of the internet presence on the domain is that it uses what are called social plugins (‘plugins’) from the social network, which are operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (‘Facebook’). These plugins are indicated by a Facebook logo.
When you access the internet presence on the domain, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transferred by Facebook directly to your browser, which then integrates it into the website. Integration of the plugin causes Facebook to receive the information that you have accessed on the corresponding page of the internet presence. If you are logged in with Facebook, it will be able to assign your visit to your Facebook account. MHM sends out E-mails on a regular basis to keep you up to date with franz. You can unsubscribe from the mailing list by clicking the “Unsubscribe” link.

8. Log files

 Every time you access our website, usage data will be forwarded by your browser to us and stored in log files. Log files may contain the following information: Date and time of your request, name of the requested page, IP address, referrer URL (URL of origin from which you have come to the site), the data volume transferred, product and version information on the browser used.
The IP addresses of users are deleted or made anonymous after ending the session. In making IP addresses anonymous, they are changed such that the individual details about personal or factual circumstances can no longer, or only with a disproportionate investment of time, cost and labor, be associated to an identified or identifiable natural person.
Log file records will be used by us in an anonymous way to further improve the website, make it more user-friendly and to find and fix errors more quickly. They may also be used to manage server capacity providing adequate data volume should the need arise.

9. Secure data transfer

 Your personal data is transmitted securely by us through encryption. This applies to both your registration as well as for all data transfers after your login. We use the TSL (Transport Layer Security) protocol to provide data encryption. While no one can guarantee absolute protection, we secure our website and other systems with technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons.
We expressly point out that data transmission over the Internet (e.g. communication by e-mail) cannot be protected completely against access by third parties.

1. The competition franz. and general use of the Website

1.1. The following terms govern the use of the website (“Website”) provided by MHM and the application for and participation in the competition for ideas future of sports “franz. Create the future of sports.” (“ franz.”) which is conducted by MHM. franz. is the very first international student competition for ideas in sports, where undergraduate and graduate top students from leading schools around the world are asked to bring new ideas that will be taken up by the world’s most preeminent sports institutions. franz. is named after Franz Beckenbauer and is a vital part of CAMP BECKENBAUER (“CB”) – a year-round project which has its climax at the annual event of CB Global Summit. CB focuses on the upcoming challenges in sports and associated areas in business, the media and politics. CB and its partners aim to go beyond a top-level discussion forum, to evoke new ways of thinking, to simultaneously develop goal-oriented solutions and, best of all, to trigger changes in the world of sports. Developing such solutions with decision-makers in sports only is not enough. Therefore, the competition franz. has been jointly created and developed by MHM and CAMP BECKENBAUER Management GmbH (“CB GmbH”), a subsidiary of MHM Marcus Höfl Management GmbH. CB GmbH is the owner of all rights with respect to CB and franz. and the responsible company organizing the year-round project CB. WHU delivers the content and the set-up of the Website for the competition franz. as WHU scientifically supports CB.

1.2. Our general online services are designed and addressed to students from all over the world interested in the competition franz. and those students who are applying and participating in the competition franz. (“User”). Terms and conditions subject to change without notice.

1.3. By accessing or using the Website and/or participating in the competition franz. with log-in or where a log-in is not required you agree to these terms and conditions contained herein (collectively, the “Terms of Use”). MHM or CB GmbH may amend, modify or replace terms and conditions found within this Terms of Use at any time and without notification.

2. Application process and participation in the competition franz.

2.1. As a first requirement for a participation in the competition franz., students should form a team which consists of registered undergraduate or graduate students. Only undergraduate and graduate students who are officially registered at a school, university and/or university of applied sciences are allowed to take part in the competition franz. The sign-up and application process for the competition franz. is exclusively available online on the Website and free of charge. WHU accepts a minimum of three members and a maximum of four members per team. Only one sign-up per team is permitted.

2.2. The team shall ensure to include CVs of all team members (one page per team member). The applicant who submits the application for the team members has to ensure that he is authorized to submit the application on behalf of the other team members. Furthermore, the team has to provide a link to PowerPoint presentation that tells the story of the team’s innovation in a compelling way. There are no technical requirements for the presentation, but it should not be longer than 10 pages. The application process will be closed by 20 November 2016.

2.3. The competition is designed to have the following structure:

2.3.1. Round One: MHM will select subject to their sole discretion in a non-public process the best ideas that have been submitted. There is no quota for teams qualifying for round two.

2.3.2. Round Two: Selected Teams for round two will get a detailed briefing for the further process of the competition franz. and what is expected by the participants. WHU will in particular provide material and examples on how the participant’s idea should be developed into a concrete proposal for the competition backed business impact figures.

2.3.3. Round Three: MHM will again select subject to their sole discretion in a non-public process, the competitions finalists. The finalists have the right to travel to Germany to present their ideas before a Jury of experts. MHM will arrange the finalists’ traveling and logistics accordingly. Costs of travel departing to and from the city of the students current host university, 1 night accommodation and meals are covered. Expenses for personal and leisure/free-time activities are not covered, nor are changes or re-bookings to your travel.

3. Changes in the competition

3.1. The format, the date, the timetable and the design of the competition franz. and of any events taking place in the context of the competition franz. are subject to the sole discretion of MHM and CB GmbH. MHM and CB GmbH also have the right to cancel the competition franz. at any time of the competition. Any right of the User, the participants and the team as a whole to claim compensation in these cases shall be expressly excluded.

3.2. MHM and CB GmbH have the right to exclude participants and/or a team in case of a violation of these Terms of Use or any other objective reason, in particular if participants provided false information in the application process, in case of cheating and/or in case of posting or making otherwise public false or defamatory statements or information regarding MHM, CB GmbH, the competition franz. and/or its representatives. Any right of the User, the participants and the team as a whole to claim compensation in these cases shall be expressly excluded.

4. Rights of Use and Intellectual Property

4.1. The use of any information made available on or via this website and the participation in the competition franz. after the sign-up process is subject to these Terms of Use.

4.2. The text, images, graphics, sound files, animation files, video files, and their arrangement on the website are all subject to copyright and other intellectual property protection. These objects may not be copied for commercial use or distribution, nor may these objects be modified or reposted to other sites.

4.3. The User and/or the participant of the competition franz. warrants that he is the legal owner of any and all commercial marketable intellectual property rights, in particular copyright, in relation to the provided video material uploaded on the Website within the password-protected application area. The User shall defend, indemnify and hold harmless MHM and CB GmbH, from and against all costs, charges and expenses (including attorneys’ fees) arising out of the use of the granted rights.

4.4. By accepting these Terms of Use the User irrevocably grants to MHM and CB GmbH exclusively all assignable intellectual property rights of the provided video material, in particular copyright but explicitly excluding moral rights, without limitation in relation to place and time for all and any commercial and non-commercial usage purposes. The grant of rights encloses in particular but not limited to the right to use, reproduce, broadcast, transmit, publicly perform and display and distribute the video material.

5. Registration, Password

5.1. Some pages of the website are password-protected, in particular the application area to the competition franz. Users are required to provide their personal data and upload video material.

5.2. The user will be provided with an access code after the sign-up process, comprising of a user ID and a password (“User Data“). The user data allows the user to view or change its data or, as applicable, to withdraw its consent to data processing as well as uploading video material.

5.3. The user shall give accurate personal information as required in the password secured area (e.g. name, surname, contact e-mail, country of origin, name of University, subject of studies) and, where such information changes over time, update such information online without undue delay. The user shall ensure that their e-mail address, as supplied to MHM, is current at all times and is an address at which the user can be contacted.

5.4. In the interest of security of personal data and copyright protection, only registered users may access password-protected pages. MHM reserves the right to deny registration to any user. MHM particularly reserves the right to make certain pages, which were previously freely accessible, subject to registration. MHM is entitled, at any time and without obligation to give reasons, to deny the user the right to access the password-protected pages by blocking their user data, in particular if the user uses false data for the purpose of registration, and/or violates these Terms of Use, and/or neglects their duty of care with regard to user data, and/or violates any applicable laws in the access to or use of the website.

5.5. The user shall ensure that user data is not accessible by third parties and is liable for all transactions and other activities carried out under their user data. At the end of each online session, the user shall log-off from the password-protected websites. If and to the extent the user becomes aware that third parties are misusing its user data the user shall notify MHM thereof without undue delay in writing, or, as the case may be, by e-mail.

5.6. The user may at any time request deletion of personal information in writing, provided that the deletion will not violate the proper performance of contractual relationships. In such event MHM will remove all user data and other stored personally identifiable data of the user as soon as these data are no longer needed.

6. General services of the Website

6.1. This Website contains specific information related to the competition franz. and online video content provided by the user for viewing or downloading. In addition hereto, the website contains supplementary data and information about the past Summit and the upcoming Summit.

6.2. WHU may cease operation of the website in full, or in part, at any time. Due to the nature of the internet and computer systems, MHM cannot accept any liability for maintaining the continuous availability of the website.

7. Intellectual Property

Notwithstanding the particular provisions in § 4 of these Terms of Use, any and all information, brand names (e.g. franz. create the future of sports.) and other contents of the website and the competition franz. itself are legal property of CB GmbH and may not be changed, copied, reproduced, sold, rented, used, supplemented or otherwise used in any other way, unless otherwise permitted in writing by CB GmbH.

8. Hyperlinks

The website may contain hyperlinks to the web pages of third parties. MHM has no liability for the contents of such web pages and does not make representations about or endorse such web pages or their contents as its own, as MHM does not control the information on such web pages and is not responsible for the contents and information given thereon. The use of such web pages shall be at the sole risk of the user.

10. Newsletter

10.1. By completing the sign-up process the user is accepting to receive MHM’s regular e-mails to the users e-mail address. The regular mails contain relevant information about the ongoing competition franz. itself and related issues as information about the year-round project of CB.

10.2. If at any time the user would like to be removed from the MHM mailing list, the user may do so by clicking the “unsubscribe” link.

11. Final provisions

11.1. Recourse to the courts is not permitted.

11.2. These Terms of Use shall be governed by the laws of Germany. Exclusive place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Dusseldorf, as far as legally permissible.

11.3. If any provision of these Terms of Use is or becomes invalid that shall not affect the validity of the remainder of the Terms of Use. In such event the respective invalid provision or gap shall be replaced by a provision which comes closest to the commercial purpose of the respective invalid provision.
